We are Design and Pen Academy ('Company', 'we', 'us', or 'our'), a company registered in India at Hislop Rd, Secunderabad, Telangana 500010. We operate the website https://www.designandpen.com (the 'Site'), and any related products and services (the 'Services').
Design and Pen is a coaching and learning platform that offers structured programs, masterclasses, and resources designed to support working women and mothers in building a balanced, calm, and sustainable lifestyle.

These Legal Terms constitute a legally binding agreement. By accessing the Services, you agree to be bound by all of these Legal Terms. If you do not agree with all of these Legal Terms, you are prohibited from using the Services and must discontinue use immediately.
Changes to these Legal Terms will become effective seven (7) days after notice is given, except for security updates, bug fixes, or court orders, which take effect immediately. The Services are intended for users at least 18 years old.

All products are subject to availability. We reserve the right to discontinue any products at any time. Prices are subject to change.
6. Purchases and Payment
We accept the following forms of payment: Visa, Mastercard, American Express, UPI, Net Banking.
You agree to provide current, complete, and accurate purchase and account information. Sales tax will be added where required. All payments shall be in Indian Rupees (INR), US Dollars (USD), or Euros (EUR).
7. Refunds Policy
All sales are final, and no refund will be issued.
8. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to:

- Trick, defraud, or mislead other users or us.

Additional prohibited activities: sharing, distributing, or reproducing course content, recordings, or materials without permission; recording or redistributing coaching sessions, group calls, or community discussions without consent; misusing community spaces (including WhatsApp groups or forums) for spam or unsolicited outreach; engaging in harmful or disrespectful behaviour towards other members; attempting to copy, replicate, or resell any part of the programs, systems, or frameworks.
9. User-Generated Contributions
When you create, submit, or post Contributions, you represent that they do not infringe third-party rights, are not false or misleading, are not obscene or offensive, do not violate any law, and do not violate the privacy or publicity rights of any third party.
10. Contribution Licence
By posting Contributions, you grant us an unrestricted, irrevocable, perpetual, non-exclusive, royalty-free, worldwide licence to use, reproduce, distribute, and display such Contributions. You retain ownership of your Contributions.
11. Guidelines for Reviews
Reviews must be from firsthand experience, must not contain offensive language or discriminatory references, must not reference illegal activity, and must not contain false statements. We may accept, reject, or remove reviews at our sole discretion.
12. Third-Party Websites and Content
The Services may contain links to third-party websites and content. We are not responsible for them, and you access them at your own risk.
13. Services Management
We reserve the right to monitor the Services for violations, take appropriate legal action, refuse or restrict access, and manage the Services to protect our rights and facilitate proper functioning.

Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Any dispute shall be referred to the International Commercial Arbitration Court under the European Arbitration Chamber. The seat of arbitration shall be Hyderabad, India. The language shall be English.
20. Corrections
There may be information on the Services that contains typographical errors. We reserve the right to correct any errors at any time without notice.
21. Disclaimer
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
22. Limitations of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US.
23. Indemnification
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand arising from your Contributions, use of the Services, breach of these Legal Terms, or violation of third-party rights.

If any complaint is not satisfactorily resolved, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.

These Legal Terms constitute the entire agreement between you and us. Our failure to enforce any right shall not operate as a waiver. If any provision is unenforceable, it is severable and does not affect the remaining provisions.
28. Payments, Refunds, and Program Participation
All purchases are final. No refunds will be provided once access has been granted. Users on payment plans must complete all remaining payments as agreed, regardless of participation. Results may vary; we do not guarantee specific outcomes. We reserve the right to remove access to any user who engages in disruptive, abusive, or inappropriate behavior, without refund.
